It refers to realistic suggestion from Union Ministry for Law and Justice to raise retirement-age of high court judges from present 62 years to 65 years making it at par with that of Supreme Court judges.

Apart from other advantages, it will make some deserving but superseded chief justices of states in regard to their elevation to Supreme Court, to provide their valuable service in judiciary at least at high court level for up to age of 65 years. Raising retirement-age of high court judges should be done as a new-year gift through an ordinance after taking in confidence leaders of opposition parties so that some more superseded but deserving chief justices of states like Justice AP Shah of Delhi High Court may not pre-maturely retire from judiciary at present age-limit of 62 years.

It may be recalled that even Prime Minister's Office (PMO) intervened, though in vain, on superseding three such chief justices at high courts namely Justice AK Patnaik, Justice AP Shah and Justice VK Gupta without any reason for such superseding in present non-transparent system of judicial appointments. Noted jurist Fali S Nariman in his speech on November 16, 2009, at National Law University (Delhi) clearly hinted at personal equations being followed in judicial appointments when he pointed out that Justice AK Patnaik could be elevated to the apex court only after retirement of a particular collegium-member from the Supreme Court even though Justice AK Patnaik was earlier three times superseded in elevation to apex court.
